2. GHANIPOUR is challenging the fact that the first judge granted the divorce on the basis of Belgian law.

She believes that the divorce should be pronounced in accordance with Iranian law since the application of Belgian law in this case leads to a violation of the principle of equality and constitutes a violation of the Charter of Fundamental Rights of the European Union referred to in the thirtieth introductory Recital of Council Regulation No 1259/2010 of 20 December 2010 on enhanced cooperation in the field of the law applicable to divorce and legal separation ('Rome III') (hereinafter: Rome III-Vo).

More specifically, she argues that pronouncing the divorce in accordance with Belgian law allows MOHAMMAD ZAKI to be considered divorced for Iran (or under Iranian law), but she herself is still considered a married woman as long as the marriage has not been terminated according to Iranian law.
