English to Persian (Farsi) Law/Patents Law: Contract(s)

In application of Article 17 of Council Regulation (EU) No 2201/2003 of 27 November 2003 on jurisdiction and the recognition and enforcement of judgments in matrimonial matters and in matters of parental responsibility, and repealing Regulation. (EC) No 1347/2000 (Brussels IIa Regulation), the Court must examine ex officio its international jurisdiction.

This Regulation applies as soon as a divorce action is initiated before a court of a Member State of the EU.

The reference points are listed in art. 3 of the regulation. There is no hierarchy between the different grounds of jurisdiction. These are alternatives that are on equal footing.

MOHAMMAD ZAKI Majid has chosen this court to initiate his divorce action. GHANIPOUR Zahra does not dispute the jurisdiction of this court. This court has jurisdiction to hear the divorce action on the basis of art. 1. a) first indent (the habitual residence of the spouses).
