פקודת בריאות הציבור (מזון) [נוסח חדש], תשמ"ג-1983*
פרק א': פרשנות
1. בפקודה זו –
"התוויה" – סימון מצרך, ציונו, כינויו או תיאורו בדרך אחרת;
"כימאי ממשלתי" – מי ששר הבריאות מינהו להיות כימאי ראשי, לרבות סגנו ולרבות עובד אחר של משרד הבריאות שהכימאי הראשי הסמיכו לבצע אנליזות;
"מזון" – כל מצרך, זולת סמים או מים, המשמש מזון או משקה לאדם, וכל מצרך שבדרך כלל נותנים אותו במזון אדם או משתמשים בו להרכבתו או להכנתו, לרבות חמרים נותני טעם ותבלינים;
"מזון מזויף" – מזון שעורב בו חומר זר, או שנגרע חלק מחלקיו, הכל באופן המשפיע על איכותו, מהותו או תכונותיו, זולת אם נקבע אחרת בפקודה זו;
"מכירה" –
(1) מכירה בסיטונות או בקמעונות;
(2) הצעה למכור;
(3) פרסום, הצגה, שמירה, העברה, משלוח, יבוא, הובלה או מסירה לשם מכירה;
(4) גרם מכירה;
(5) הכנה או החזקה לשם מכירה;
(6) החלפה, המרה, הספקה או עשייה אחרת, בתמורה ישירה או עקיפה;
"המנהל" – המנהל הכללי של משרד הבריאות;
"מפקח" –
(1) רופא ממשלתי;
(2) פקח של משרד הבריאות;
(3) פקיד אחר של משרד הבריאות שהמנהל הסמיכו;
(4) תברואן או מפקח של רשות מקומית שמועצתה הסמיכה אותו לגבי חצרים שבתחומה;
(5) מפקח לפי פקודת המשקלות והמידות, 1947;
(6) פקיד מכס כמשמעו בפקודת המכס;
(7) עובד המדינה אחר שהמנהל הסמיכו בכתב;
"צרור" – כל דבר שעוטפים, אורזים או מצרפים בו טובין או שנותנים לתוכו טובין;
"רופא ממשלתי" – רופא, או רופא וטרינרי, שהוא עובד המדינה או עובד רשות מקומית;
"רשות מקומית" – עיריה או מועצה מקומית שנתכוננה לפי פקודת המועצות המקומיות;
"תווית" – סימן או ציון או כל דבר מודפס, מצוייר או מתאר אחר המופיע על מזון, צמוד אליו או ארוז עמו והמתייחס למזון או לצרור המכיל אותו.
2. לענין פקודה זו, מזון ייראה כנועד למכירה למאכל אדם זולת אם הוכח היפוכו של דבר.
פרק ב': סמכויות
3. המנהל רשאי, באישור שר הבריאות, להתקין תקנות המרשות – דרך כלל או ביחס לאזור או למקום שיפורטו – נקיטת אמצעים למניעת סכנה לבריאות הציבור מיבוא, הכנה, החסנה והפצה של מזון שנועד למכירה למאכל אדם, וכן למניעת סימון כוזב של מזון, ובלי לגרוע מכלליות הסמכויות הניתנות בזה, יכולות תקנות כאמור –
(1) להורות על התוויה נאותה של צרורות מכילי מזון;
(2) להגדיר, לפי הצורך, איכותו, מהותו ותכונותיו של מזון, לפרט תקנים הנדרשים ביחס למזון כאמור ולקבוע איזה חסר ברכיב מן הרכיבים הרגילים של חומר, ואיזו תוספת של דבר זר בחומר או איזה שיעור של מים בו, יהיו לענין פקודה זו ראיה לכך שאין החומר אמיתי או שהוא מזיק לבריאות;
(2א) לקבוע הוראות בדבר סימון הימצאות גלוטן במזון;
(3) לקבוע נהלים לנטילת דוגמאות מזון ולהורות על בדיקתם;
(4) להורות על גביית תשלום שהתקנות מתירות הטלתו לענין התקנות או לענין השירותים הניתנים לפיהן;
(5) להחיל לגבי הענינים שניתן לקבעם בתקנות הוראות חיקוק אחר הדנות בענינים דומים, בשינויים ובהתאמות המחוייבים.
3א. שר הבריאות, באישור ועדת העבודה הרווחה והבריאות של הכנסת, יקבע הוראות בדבר חובת סימון אזהרה על גבי אריזות של פיצוחים, ממרחים, גרעיני תירס ונקניקיות משום שיש באכילתם על ידי ילדים מתחת לגיל 5 סכנת חנק, וכן בדבר סימון אזהרה כאמור בשלט במקום ממכר, שלא באריזה של המוצרים האמורים; בסעיף זה –
"פיצוחים" – סוגים שונים של גרעינים ואגוזים המשווקים לאכילה כפי שקבע השר בתקנות, בין כשהם נמכרים עם הקליפה, ובין בלעדיה;
"ממרחים" – ממרחים על בסיס שומני המכילים חתיכות פיצוחים קלופים;
"גרעיני תירס" – גרעיני תירס וגרעיני תירס תפוחים (פופקורן);
"נקניקיות" – כהגדרתן בצו הפיקוח על מצרכים ושירותים (נקניק ונקניקיות), התשל"ו-1975, או תערובת על בסיס חלבון מן הצומח בשרוול העשוי מחומר סינתטי דמויית נקניקיה.
4. מפקח רשאי –
(1) להשיג, בדרך שנקבעה בתקנות, כל דוגמת מזון;
(2) להיכנס לחצרים שמוכרים בהם מזון כדי להשיג דוגמאות לאנליזה או כדי לברר אם מפירים שם פקודה זו או תקנות שלפיה;
(3) להשיג – אך ורק לבקשת הקונה או הנשגר, או בהסכמתם – כל דוגמת מזון במקום שמוסרים אותו ובמהלך המסירה לידיהם.
5. מפקח ימציא לרופא המחוז או הנפה הנוגעים בדבר, לשם אנליזה בידי כימאי ממשלתי –
(1) כל דוגמת מזון שהשיג בתוקף סמכותו שבסעיף 4(1), אם הוא חושד כי היא נמכרה לו בניגוד להוראות פקודה זו או תקנות שלפיה;
(2) כל דוגמת מזון שהשיג בתוקף סמכותו שבסעיף 4(3), אם הוא חושד כי היא נמכרה בניגוד להוראות פקודה זו או תקנות שלפיה.
6. כימאי ממשלתי יערוך, בהקדם האפשרי, אנליזה לכל דוגמת מזון שהמציא לו מפקח ויתן לרופא המחוז או הנפה הנוגעים בדבר תעודה – לפי הטופס שבתוספת או בדומה לו ככל האפשר – שבה יפורטו תוצאות האנליזה.
7. רופא ממשלתי, שמצא כי מזון המוצג למכירה עלול להזיק לבריאות אדם או שאינו ראוי למאכל אדם, מחמת רקב, הזדהמות או כל סיבה אחרת, רשאי לפסול מזון כזה ולצוות על השמדתו, או למנוע באופן אחר את השימוש בו למאכל.
8. (א) מפקח רשאי לבדוק ולבקר כל מזון שיובא לישראל או שנשלח לכל מקום בישראל, בין בהיותו במעבר ובין לאחר הגיעו ליעדו, וליטול ממנו דוגמאות ולהעבירן לבדיקה או אנליזה; כל דוגמה הניטלת כך בבית המכס, תינטל בלא תשלום.
(ב) מזון כאמור יחד עם מזון דומה לו שבאותו משלוח, ניתן לעכב בשמירת אגף המכס ומע"מ, לפי שיקול דעתו של המנהל או של מנהל המכס ומע"מ, עד שיושלמו הבדיקה או האנליזה הדרושות; ובלבד שהבדיקה או האנליזה תבוצע בהקדם האפשרי.
(ג) הראו בדיקה או אנליזה כאמור שהמזון זוייף או שניתן לו תיאור כוזב, או שהוא מזון אסור, או שאינו תואם בדרך אחרת את הוראות פקודה זו או תקנות שלפיה, רשאי שופט בית משפט שלום, לפי צו חתום ביד המנהל או רופא ממשלתי המופקד על לשכת בריאות מחוזית, לצוות כי המזון וכל מזון דומה לו שנכלל באותו משלוח –
(1) יחולט וכן רשאי לצוות כי יושמד;
(2) יוחזר לנמל המוצא של המשלוח;
(3) יותר ליבוא לאחר התווייתו מחדש להנחת דעתו של המנהל;
(4) יטופל או ייעשה בו בדרך אחרת, כפי שיורה המנהל.
(ד) נתגלה מתוך בדיקה או אנליזה כאמור כי מזון כלשהו עלול להזיק לבריאותו של אדם, או שאינו ראוי למאכל אדם, מחמת רקב, הזדהמות או כל סיבה אחרת, רשאי רופא ממשלתי לפסול את המזון ולצוות להשמידו או למנוע באופן אחר את השימוש בו למאכל אדם; הודעה על כך תישלח לבעל המזון לפני ביצועו של הצו או לאחריו לפי ראות עיניו של הרופא.
9. רשות מקומית תורה לפקידיה ליטול דוגמאות מפעם לפעם, לפי הצורך, כדי להבטיח מכירת מזון טהור ואמיתי.
פרק ג': עבירות
10. לא יזייף אדם מזון ולא יוסיף לו כל חומר משמר, חומר צבע או חומר אחר שנאסרו בתקנות לפי פקודה זו, ולא ימכור מזון מזויף או מזון המכיל חומר כאמור.
10א . (א) בסעיף זה –
"בשר", כל אחד מאלה:
(1) שרירי השלד של בהמות כהגדרתן בתקנות מחלות בעלי חיים (שחיטת בהמות), התשכ"ד-1964, עם עצמות או בלעדיהן;
(2) עופות כהגדרתם בתקנות מחלות בעלי חיים (בתי שחיטה לעופות), התש"ך-1960, עם עצמות או בלעדיהן ועם עור או בלעדיו;
(3) סוגי בהמות או עופות נוספים שקבע שר החקלאות;
"בשר מיושן" – בשר מצונן שעבר תהליך של הבחלה טבעית בטמפרטורה שלא עלתה על שתי מעלות צלסיוס במשך ארבעה עשר ימים רצופים לפחות;
"בשר מיושן קפוא" – משר מיושן שהוקפא לאחר תהליך ההבחלה;
"בשר טרי", "בשר מצונן" – בשר אשר לא עבר תהליך טיפול כלשהו, למעט צינון בטמפרטורה שלא עלתה על ארבע מעלות צלסיוס ולא פחתה מאפס מעלות צלסיוס, ובלבד שנשמרו תכונותיו הטבעיות של הבשר;
"בשר קפוא" – בשר אשר לא עבר טיפול כלשהו, למעט הקפאה בטמפרטורה פנימית שלא עלתה על שתים עשרה מעלות צלסיוס מתחת לאפס;
"טיפול" – טיפול מכל סוג שהוא בבשר, לרבות הוספת מים, תבלינים, חומרי כבישה או חומרים אחרים וכן הפשרה וכבישה ולמעט ניקור, הכשרה, פירוק, פריסה ואריזה;
"מוצר בשר מעובד" – מוצר המיוצר מבשר מצונן או מבשר קפוא שעבר טיפול;
"תכונות טבעיות של בשר" – טעם, צבע, ריח ומרקם.
(ב) הוסיף אדם מים או חומר מכל סוג שהוא לבשר מיושן, לבשר מיושן קפוא, לבשר מצונן או לבשר קפוא, לא ישווק, לא יימכר ולא יסומן הבשר האמור, אלא כמוצר בשר מעובד, לפי הוראות סעיף זה.
(ג) לא ישווק אדם, לא ימכור, לא יסמן, לא יחסין ולא ייבא בשר כבשר מיושן, אלא אם כן הוא בשר מיושן.
(ד) לא ישווק אדם, לא ימכור, לא יסמן, לא יחסין ולא ייבא בשר כבשר מיושן קפוא, אלא אם כן הוא בשר מיושן קפוא.
(ה) לא ישווק אדם, לא ימכור, לא יסמן, לא יחסין ולא ייבא בשר כבשר טרי או כבשר מצונן, אלא אם כן הוא בשר טרי או בשר מצונן.
(ו) לא ישווק אדם, לא ימכור, לא יסמן, לא יחסין ולא ייבא בשר כבשר קפוא, אלא אם כן הוא בשר קפוא.
(ז) מוצר בשר מעובד לא יכיל חומר מכל סוג שהשר קבע לגביו הגבלות או איסורים לפי הוראות פסקה (ט)(1).
(ח) לא ישווק אדם ולא ימכור מוצר בשר מעובד אלא אם כן הוא מסומן במילים "מוצר בשר מעובד" או "מוצר המכיל בשר"; שר הבריאות יקבע הוראות בדבר סימון מוצר בשר מעובד כמוצר בשר מעובד או כמוצר המכיל בשר.
(ט) שר הבריאות, באישור ועדת העבודה הרווחה והבריאות של הכנסת יקבע בתקנות את כל אלה:
(1) סוגי חומרים שאסור להוסיפם למוצר בשר מעובד;
(2) אופן סימון שיעור המים שמוצר בשר מעובד שלא עבר טיפול בחום מכיל, ודרכי חישוב של שיעור המים המוסף במוצר בשר מעובד מסוים;
(3) אופן סימון מוצר בשר מעובד, לרבות מוצר המכיל בשר, בשר מיושן, בשר מיושן קפוא, בשר מצונן ובשר קפוא, לרבות אופן סימון החומרים והמים שהוספו, גודל האותיות, וכללים נוספים בדבר האריזה.
(י) תקנות לפי סעיף זה יכול שיהיו כלליות או לסוגים שונים של מוצר בשר מעובד, כפי שקבע השר.
(יא) הוראות סעיף זה באות להוסיף על הוראות כל דין.
11. לא יוסיף אדם למזון כל חומר משמר או חומר צבע מכל סוג אלא כפי שהותר בתקנות לפי פקודה זו, ולא ימכור מזון שהוסף לו חומר כאמור.
12. לא ימכור אדם מזון בלא שהותווה כנדרש בתקנות לפי פקודה זו, או שמשקלו הנקי אינו תואם את האמור בתווית.
13. לא ימכור אדם מזון שאיכותו נפגמה מחמת רקב, הזדהמות או כל סיבה אחרת.
14. לא ימכור אדם מצרך מזון שמשקלו, איכותו, מהותו או תכונותיו שונים לרעה ממה שביקש הקונה; אולם לא ייחשב אדם כעובר על הוראה זו אם נתקיים אחד מאלה:
(1) חומר או רכיב בלתי מזיקים לבריאות הוספו למזון בהיותם נדרשים לייצורו או להכנתו של המזון כמצרך מסחרי הניתן להובלה או לצריכה, והדבר לא נעשה במרמה לשם הגדלה של הנפח, המשקל או המידה של המזון או לשם הסוואת איכותו הנחותה;
(2) המזון הוא נושא לפטנט תקף והוא מסופק כפי הנדרש במיפרט של הפטנט;
(3) המזון עורב באופן בלתי נמנע בחומר זר במהלך ההכנה או האיסוף.
15. לא יגרע אדם ממשקלו, איכותו, מהותו או תכונותיו של מזון, מתוך כוונה שהוא יימכר כך, ולא ימכור מזון ששונה כאמור, והכל אם לא גילה את דבר השינוי.
16. לא יסרב אדם למכור למפקח המבקש לקנות מזון המוצג או המצוי למכירה קמעונית בכל חצרים, חנות, מחסן, רחוב או מקום פתוח לציבור, אם המפקח הציע את מחיר השוק לכמות הדרושה לו לשם אנליזה והכמות אינה עולה על הדרוש לכך באופן סביר.
17. (א) לא יכשיל אדם ולא יעכב, במזיד, מפקח במהלך תפקידיו לפי פקודה זו.
(ב) לא ימנע אדם ולא ינסה למנוע ממפקח למלא כראוי את תפקידו לפי פקודה זו, על ידי מתנה, שוחד, הבטחה או פיתוי אחר.
18. לא יסרב אדם להרשות למפקח ליטול את כמות המזון שהוא רשאי להשיג לפי סעיף 4 לשם עריכת אנליזה.
19. (א) לא יתן אדם עם מזון שהוא מוכר תעודת אחריות שהיא כוזבת או מטעה בפרט כלשהו; אולם לא ייחשב אדם כעובר על הוראה זו אם הוכיח להנחת דעתו של בית המשפט, שבעת שנתן את תעודת האחריות היה לו יסוד להניח שהאמרות או התיאור שבה אמת.
(ב) הליכים לפי סעיף זה ניתן לנקוט בבית המשפט שבתחום סמכותו מצוי המקום שבו נמכר המזון או ניטלה ממנו דוגמה או בבית המשפט שבתחום סמכותו מצוי המקום שבו ניתנה תעודת האחריות.
20. לא ייחס אדם במזיד למזון, בהליך לפי פקודה זו, אישור או תעודת אחריות שניתנו לגבי מזון אחר.
21. לא יתן אדם במזיד, עם מזון שהוא מוכר, תווית הנותנת למזון תיאור כוזב.
22. לא יעבור אדם, בין בעצמו ובין על ידי עובדו או שלוחו, על תקנה לפי פקודה זו.
23. (א) המפר הוראת סעיפים 10 עד 22, דינו – מאסר שנה.
(ב) על אף האמור בכל דין, מי שלגבי ענין מעניני פקודה זו מזייף אישור או כתב אחר המתחזה להיות תעודת אחריות או מפיץ אותם בידיעה שהם מזוייפים, דינו – מאסר שנתיים.
24. לא יאשם אדם בעבירה לפי פקודה זו ביחס למכירת מזון שעורב בו חומר או רכיב בלתי מזיקים לבריאות, ושלא נועדו להגדלה במרמה של הנפח, המשקל או המידה של המזון או להסוואת איכותו הנחותה, אם בזמן מסירת המזון נתן למקבל הודעה בתווית שהודפסה באופן ברור, מובלט וקריא, בשפה אחת לפחות מבין השפות הרשמיות, על המזון או במצורף לו, לענין היות המזון מעורב; תווית תיראה כממלאת דרישות אלה רק אם אין בה דבר אחר המסתיר את ההודעה האמורה.
25. באישום לפי פקודה זו לא תהיה זו הגנה לנאשם, שהקונה קנה לשם אנליזה בלבד ומשום כך לא ניזק בשל אותה מכירה.
26. (א) בהליכים לפי פקודה זו תשמש תעודה של כימאי ממשלתי ראיה מספקת לעובדות שנקבעו בה, זולת אם ידרוש הנאשם כי אותו כימאי יוזמן כעד וכי יוצגו חלקי המזון המוחזקים בידי מי שרכש אותם.
(ב) התעודה לא תהא קבילה בבית המשפט אלא אם ממצאיה נמסרו לנאשם, כפי שקבע שר הבריאות בתקנות, תוך עשרים ואחד ימים מהתאריך הנקוב בה כתאריך סיום הבדיקה; בית המשפט רשאי להאריך תקופה זו מטעמים מיוחדים.
27. (א) תהא זו הגנה טובה לנאשם אם הוכיח כל אלה להנחת דעת בית המשפט:
(1) רכש את המזון הנדון במשקל, איכות, חומר ומהות כפי שביקש ממנו הקונה ובצירוף תעודת אחריות לענין זה; ואולם תעודת אחריות לא תשמש הגנה בכל הליך לפי פקודה זו אם המזון שלגביו ננקט ההליך הינו חָלָב;
(2) לא היה לו יסוד להניח, בזמן שמכר את המזון, כי המזון אינו כאמור בפסקה (1);
(3) הוא מכר את המזון באותו מצב שבו רכש אותו.
(ב) על אף האמור בסעיף קטן (א), יהא על הנאשם לשלם את הוצאות התביעה, זולת אם נתן הודעה מספקת לתובע כי הוא עתיד להסתמך על הגנה של תעודת אחריות.
28. (א) תעודת אחריות לא תשמש הגנה באישום לפי פקודה זו אלא אם הנאשם שלח לתובע, תוך שבעה ימים מהיום שהומצאה לו הזמנה לדין, העתק מתעודת האחריות בצירוף הודעה בכתב שבכוונתו להסתמך בהגנתו על התעודה, וציין בהודעה את שמו ומענו של האדם שממנו קיבל את התעודה, וכן שלח לאותו אדם הודעה על כוונתו זו.
(ב) מי שטוענים כי נתן תעודת אחריות כאמור, זכאי להופיע בדיון ולהעיד, ובית המשפט רשאי, אם מצא זאת לנכון, לדחות את הדיון כדי לאפשר לו להעיד.
(ג) תעודת אחריות שניתנה מחוץ לישראל לא תשמש הגנה באישום לפי פקודה זו, אלא אם הנאשם הוכיח כי נקט צעדים סבירים לוודא את נכונות האמרות או התיאור שבה וכי האמין בכך.
(ד) כשהנאשם הוא עובדו של האדם שרכש את המזון בהתאם לתעודת אחריות, הוא יהא זכאי, בכפוף להוראות סעיף זה, להסתמך על סעיף 27 כדרך שהגנה כאמור היתה עומדת למעבידו אילו הועמד לדין, בתנאי שיוכיח גם שלא היה לו יסוד להניח כי המזון היה שונה ממה שביקש הקונה.
29. בית המשפט רשאי לצוות שפסק דין חלוט או תמציתו יפורסמו ברבים, בצורה ובאופן שיקבע, ולהורות מי ישא בהוצאות הפרסום; הורה בית המשפט שהנאשם ישא בהוצאות הפרסום, יהא דינו כדין קנס שהטיל בית המשפט.
30. (א) בכל הרשעה לפי פקודה זו, ניתן לחלט לזכות המדינה, לפי צו של בית המשפט, את המזון שאליו מתיחסת ההרשעה; צו כאמור יכול שיחול על כל המזון ועל כל הצרורות והכלים המכילים מזון דומה והשייכים לנאשם או שנמצאו בחצריו או בהחזקתו בשעה שנעברה העבירה.

Public Health Ordinance (Food) (new version) - 1983.
Chapter A.: Interpretation
1. In this ordinance –
"Marking" – marking a product, its indication, name or description in a different manner;
"State Chemist" – appointed by the Minister of Health to be chief chemist, including his deputy and including any other employee of the Ministry of Health whom the chief chemist appointed to perform analyses;
"Food" – any product, except drugs or water, used as food or drink for humans, and any product that is usually added in food or used to prepare and assemble food, including flavor enhancers and spices;
"Forged Food" – food into which a foreign substance was mixed or that a part of which was removed, all in a manner which effects the food's quality, essence or characteristics, except in case it was so determined in this ordinance;
"a Sale" –
A) Sale by wholesale or by retail;
B) A proposition to sell;
C) Advertising, presentation, preservation, transfer, shipment, export, transportation or delivering for the purpose of selling;
D) Sale's generation;
E) Preparation or possession for the purpose of selling;
F) Replacement, conversion, delivering or any other action, for a direct or indirect return;
"the Manager" – the General-Manager of the Ministry of Health;
"the Supervisor" –
G) A state physician;
H) A Ministry of Health supervisor;
I) Another Ministry of Health official, authorized by the Ministry's general-manager;
J) A local authority's sanitary-officer or supervisor authorized by the authority's council for premises within its jurisdiction;
K) A supervisor as per the Weights and Measures Ordinance 1947;
L) A custom clerk as per the Custom Ordinance;
M) Another civil servant authorized in writing be the manager;
"a Parcel" – anything wrapped, packed or having goods attached to it or put in it;
"a State Physician" – a physician or a veterinarian who is an employee of the state or a local authority;
"a Local Authority" – a municipality or a local council established as per the local authorities' decree;
"a Label" – a mark or an indication or any other printed or illustrated item, or any other outlining on the food, attached to it or packed with it and which relate to the food or to the parcel containing it.
2. for the purpose of this ordinance, food will be seen as designated for sale for human consumption, unless otherwise proven.
chapter B.: Authorities
3. the manager, with the Minister of Health's permission, is permitted to institute regulations which allow – as a rule or in regards with an area or a location as specified – the taking of steps to prevent any risk to the public due to export, preparation, storage and distribution of food sold for human consumption, as well as to prevent false marking of food, and without diminishing from the conclusiveness of the authorities hereby granted, these aforementioned regulations are meant – to instruct proper marking of parcels containing food;
A) to define, as necessary, the quality, the essence and the characteristics of food, to specify requested standards regarding the aforementioned food, and to determine any absence in any of the regular components of a substance, and any addition of a foreign item or any measure of water in it, that will, for the purpose of this ordinance, be evidence that the substance is not genuine or that it is hazardous to health;
2A) to determine instructions regarding the marking of the presence of Gluten in the food;
B) to determine procedures for sampling food and to order their inspection;
C) to order collection of payment that the imposition of which is permitted by the regulations, regarding the regulations or the services provided under these regulations;
D) to apply directives of a different legislation regarding any matters that can be determined in the regulations that relate to similar issues, with the necessary changes and the modifications.
3-A the Minister of Health may, with the permission of the Work Welfare and Health Knesset-Committee, institute directives regarding the obligation to put warning signs on the packages of nuts, pastes, corn kernels and sausages, as their consumption by children under the age of 5 carries the risk of strangulation; and also regarding signs of warning according to the sign posted in the place of sale, which is not on the aforementioned products in this clause –
"nuts" – different types of nuts sold for eating, as determined in the regulations by the Minister, whether they are sold in their shells or without it;
"pastes" – fatty pastes which contain pieces of peeled nuts;
"corn kernels" – corn kernels and puffed corn kernels (popcorn);
"sausages" – as they are defined in the Supervision of Products and Services Law (cold cuts and sausages), 1975, or a vegetable-protein based mixture inside a synthetic sleeve, that looks like a sausage.
4. a supervisor may –
A) obtain, as decreed by the regulations, any food sample;
B) enter any premise where food is sold, in order to obtain samples for analysis, or to investigate whether this ordinance or any regulations deriving from it are breached;
C) obtain – only at a buyer or a consignee's request or with their consent – any food sample where it is delivered and while it is delivered to them.
5. a supervisor will provide the relevant county or district's physician, for analysis by a state chemist –
A) any food sample obtained by his authority as per clause 4(1), if he suspects that it was sold to him against the directives or the regulations of this ordinance;
B) any food sample obtained by his authority as per clause 4(3), if he suspects that it was sold to him against the directives or the regulations of this ordinance;
6. a state chemist will conduct, at the earliest time possible, an analysis of every food sample provided by the supervisor and give the relevant county or district's physician, a certificate – according to the form in the addendum or as similar to it as possible – in which the analysis' results will be listed.
7. a state physician, finding food exhibited for sale that might be hazardous the human health or unworthy of human consumption, due to decay, contamination or any other reason, may disqualify that food and order its eradication, or prevent by another method its consumption for eating.
8.
A) a supervisor may inspect and control any food imported into Israel or shipped to any place in Israel, whether in transition or after it has arrived at its destination, and obtain samples from it to be taken for inspection or analysis; any sample thus obtained in customs, will be obtained free of charge.
B) Food as aforementioned, on the same shipment as similar food, can be held back at the Customs and VAT department, at the manager or the Custom and Vat manager's discretion, pending payment for the required inspection or analysis, as long as said inspection or analysis are performed at the earliest possible time.
C) Should the inspection or analysis indicate that the food is forged or that has been given a false description, or that it is prohibited, or otherwise not corresponding with the directives or the regulations of this ordinance, a magistrates court judge may, by an injunction signed by the manager or the state physician heading the county health bureau, order that said food and any other similar food in the same shipment –
1) Be confiscated, and the judge may also order its eradication;
2) Be returned to the port of departure of this shipment;
3) Be approved for export pending relabeling to the manager's satisfaction;
4) Be treated in any other manner, according to the manager's instructions.
D) Should an inspection or an analysis as aforementioned reveal that any food can be hazardous the human health or unworthy of human consumption, due to decay, contamination or any other reason, a state physician may disqualify said food and order its eradication or in any other way prevent its use for human consumption; the food's owner will be notified of the decision, prior to the execution of the injunction or after it, at the physician's discretion.
9. A local authority will order its officials to sample food from time to time, as necessary, to ensure the selling of pure genuine food.
Chapter C.: Felonies
10. a person will not forge food and will not add any preservative, coloring substance or any other substance prohibited as per the regulations of this ordinance to it, and will not sell forged food or food containing substances as aforementioned.
10-A in this clause –
"meat" is anyone of the following:
A) Skeleton muscles of animals as they are defined in the Animal Diseases (animal slaughtering) 1964, with or without bones;
B) Poultry as defined in the Animal Diseases (poultry slaughter houses) 1960, with or without bones and with or without skin;
C) Any other types of animals and poultry as decreed by the Minister of Agriculture;
"Aged Meat" – refrigerated meat that has gone through a process of natural ripening in no more than 2°C for at least 14 days;
"Frozen Aged Meat" – aged meat that has been frozen after the ripening process;
"Fresh Meat", "Refrigerated meat" – meat that was untreated except for refrigeration in no more than 4°C and no less than 0°C, as long as its natural characteristics were preserved;
"Frozen Meat" - meat that was untreated except for freezing in inner temperature of no more than 12°C bellow zero;
"Treatment" – any kind of treatment of the meat, including adding water, spices, pickling or any other substances as well as defrosting and pickling and except poking, kashrut process, disassembling, slicing and packing;
"a Processed Meat Product" – a product mad from refrigerated or frozen treated meat;
"Natural Characteristics of Meat" – flavor, color, smell and texture.
A) Should anyone add water or any other substance to aged, frozen aged, refrigerated or frozen meat, said meat will not be marketed, sold or marked as anything other than a processed meat product, as per the directives of this clause.
B) A person will not market, mark, store or export meat as aged unless it is aged.
C) A person will not market, mark, store or export meat as aged unless it is aged.
D) A person will not market, mark, store or export meat as frozen aged unless it is frozen aged.
E) A person will not market, mark, store or export meat as fresh or refrigerated unless it is fresh pr refrigerated.
F) A person will not market, mark, store or export meat as frozen unless it is frozen.
G) A processed meat product will not contain any type of substance regarding which the Minister has instituted restrictions or prohibitions as per the directives in paragraph I (1).
H) A person will not market or sell a processed meat product unless it is marked with the words: "Processed Meat Product" or "a Product Containing Meat"; the Minister of Health will institute directives regarding the marking of processed meat products as a processed meat product or a product containing meat.
I) The Minister of Health, with the approval of the Work Welfare and Health Knesset-committee, will determine all the following in the regulations:
1) Types of substances prohibited from being added to a processed meat product;
2) Manner of marking the measure of water in an untreated processed meat product, and the ways to calculate the measure of water added to a specific processed meat product;
3) Manner of marking a processed meat product, including a product containing meat, aged meat, frozen aged meat, refrigerated and frozen meat, including the manner of marking the added substances and water – the size of the letters and other rules regarding packaging.
J) The regulations of this clause can be general or specific to different types of processed meat products, as the Minister has decreed.
K) The directives in this clause are additional to the directives of the law.
11. a person will not add any preservative or coloring substance of any type to the food, unless permitted in the regulations of this ordinance, and will not sell food that the aforementioned substances were added to.
12. a person will not sell food without the marking as required by the regulations of this ordinance, or that its net weight does not correspond with the label.
13. a person will not sell food the quality of which has been compromised due to decay, contamination or any other reason.
14. a person will not sell any food product of weight, quality, essence or characteristics worse than the buyer's requests; however, a person will not be seen as violating this ordinance if any of the following occurred:
A) a substance or a component non-damaging to health were added to the food as they were required for its production or preparation as a commercial product that can be transported or consumed, and this was done in good faith, and not for the purpose of enlarging the volume, the weight or the measure of the food, or to disguise its poor quality;
B) the food is a subject of a valid patent and is supplied as per the qualifications in the patent's specifications;
C) the food has been inevitably mixed with a foreign substance in the process of preparation or collection.
15. a person will not deduct from the weight, quality, essence or characteristics of food, for the purpose of selling it as such, nor will the person sell food that is different as aforementioned, all of the above applies if the change was not disclosed.
16. a person will not refuse to sell to the supervisor requesting to buy a food product that is on display or available for a retail sale, in any premises, store, warehouse, street or any place open to the public, if the supervisor offered the market price for the quantity required for analysis, and if said quantity does not unreasonably exceed the required amount.
17.
A) a person will not intentionally obstruct or hinder a supervisor in the course of duty as per this ordinance.
B) A person will not prevent or try to prevent a supervisor from fulfilling his duty as per this ordinance, by a gift, a bribe, a promise or any other temptation.
18. a person will not refuse the supervisor sampling the food in the permitted amount as per clause 4, for the purpose of analysis.
19.
A) a person will not give a certificate of guarantee that is false or misleading regarding any detail, with the food he is selling; however, a person will not be seen as violating this directive if he proved to a court's satisfaction that at the point of giving said certificate of guarantee it was reasonable for him to assume that its contents or the descriptions in it were true.
B) It is within the authority of the court in whose jurisdiction the place of said sale or sampling of food is located to take legal action according to this clause.
20. a person will not intentionally attribute to any food, as per the procedure in this ordinance, a certificate of approval or guarantee granted to another food.
21. a person will not intentionally provide a label with a false description with the food he is selling.
22. a person will not violate this ordinance, whether by himself or by an employee or an emissary.
23.
A) the sentence for violation of clauses 10 through 20 is 1 year imprisonment
B) the stated in the law notwithstanding, a person who for the purpose of any of this ordinance issues, forges a certificate of approval or any other certificate passed as a certificate of guarantee or distributing them, knowing that they are forged will be sentenced to a 2 year imprisonment.
24. a person will not be accused of a felony as per this ordinance, regarding the selling of food in which a substance or a component un hazardous to health and not intended to falsely enlarge the volume, the weight or the measure of the food or disguise its poor quality, were mixed, if at the time of delivering the food he notified the receiver by a clearly printed label, in at least one of the formal languages, placed directly on the food or attached to it, regarding the food having been mixed; a label will be seen as fulfilling these qualifications only if nothing on it hides said notice.
25. in a conviction according to this ordinance, it will not be seen as a defense in the defendant's favor, if the buyer bought the food for the purpose of analysis only and therefore did not suffer any damage by it.
26.
A) in the procedures according to this ordinance, a state chemist certificate will be sufficient evidence for the fact specified in it, unless the defendant requests that the chemist will be summoned as a witness and that particles of the sold food in the possession of its buyer will be presented.
B) The certificate will not be admissible in court, unless its findings are disclosed to the defendant, as determined by the Minister of Health in the regulations, within 21 days of the date of the end of the inspection; the court may extend this period for special reasons.
27.
A) it will be good for the defendant's defense if he has proven the following to the court's satisfaction:
1) the food in question was purchased by him in weight, quality, substance and essence as per the buyer's request and accompanied it with a relevant certificate of guarantee; however, a certificate of guarantee will not be used in defense in any procedure according to this ordinance, if the food regarding which this procedure is taken is milk;
2) he had no reason to assume, at the time he sold the food, that said food is not as mentioned in paragraph (1);
3) he sold the food in the same condition in which it was at the time he purchased it.
B) The aforementioned in sub-clause (a) notwithstanding, the defendant will bear the costs of the proceedings, unless he has provided the plaintiff with sufficient notice that he was going to use the certificate of guarantee for his defense.
28.
A) a certificate of guarantee will not be used as defense in a conviction according to this ordinance, unless the defendant has sent the plaintiff, within 7 days of being subpoenaed, a copy of the certificate of guarantee with a written notice enclosed of his intention to use said certificate of guarantee in his defense, and provided he stated in the notice the name and the address of the person from whom he received said certificate of guarantee, and to whom he has sent notice of his intention to use it in his defense.
B) Anyone claiming that a certificate of guarantee has been such provided, may appear before the court and testify, and the court may, at its discretion, postpone the sitting to enable that person to testify.
C) A certificate of guarantee granted outside Israel will not be used in defense in a conviction according to this ordinance, unless the defendant has proven to have taken reasonable steps to verify the truthfulness of the contents or the descriptions in it and that he so believed.
D) If the defendant is an employee of the person who has purchased the food as per the certificate of guarantee, he will be entitled, subject to the directives in this clause, to rely on clause 27 in a way that the defense as mentioned would have served his employer had he been on trial, provided he also proved he had no reason to assume that the food was any different than the buyer request.
29. the court may order that a conclusive sentence or its essence will be made public, in a manner that will be determined and to determine who will bear the costs of publication; had the court ordered that the defendant will bear the costs of publication, it will be considered as a fine imposed by the court.
30.
A) any conviction according to this ordinance, the food regarded in it can, according to a court order, be confiscated to the state; an order as mentioned may apply to all the food and the parcels and the containers containing similar food that belong to the defendant or that have been found in his premises or in his possession at the time the felony was committed.
B) All the confiscated products as per a court order according to sub-clause (A), will be eradicated or treated or used in any other manner as ordered by the manager.

RAV OVADIA: GET TO KNOW OUR ARMY

“Scholars, be cautious with your words!” warn the Sages in Ethics of the
Fathers. The tongue is likened to a serpent, and so, say the Rabbis, G-d
created two gates – the teeth and the lips – through which the tongue must
pass before it can unleash its poisonous venom upon its victims.
In one ill-conceived outburst, Shas mentor Rabbi Ovadia Yosef has created
yet another firestorm, and taken a bite out of the hearts of Israel’s
bereaved families. “Should it come as a surprise that soldiers are killed
in war,” asked the rabbi, “when they do not observe Shabbat or the Torah,
when they do not pray each day, or put on Tefilin? G-d have mercy on
them and cause them to repent, so they will lead a good life in peace.”
I have agonized over Rav Ovadia’s statement, and tried to make theological
sense of it.
First, does he presume to be a prophet, and know G-d’s mind,
“who shall live and who shall die?” Second, does he propose that
non-observant soldiers are more prone to casualty than observant ones? Is
this borne out by the facts? And does he not understand that the moment a
young man dons the uniform of the IDF and places his life on the line in
the defense of Israel, he automatically rises to the level of a
Tzadik in the eyes of G-d?
Furthermore, what shall we make of the converse of the Rabbi’s remarks? Is
he suggesting that those Mitzva-observing soldiers who fell in battle were
somehow lacking in their level of observance, and by definition sinners,
because they died? Does he have any conception of how pure and righteous
these holy warriors were, how they epitomized the highest level of G-dly
behavior that a mortal man can attain?
Does he know about Roi Klein, who threw himself on a grenade in the Second
Lebanon War, blowing himself up to save his comrades, all the while
reciting Shma Yisrael, a la Rabbi Akiva? Or about Shmuel Akiva
Weiss, who pushed aside a fellow medic in Jenin in order to try to save the
life of a fallen comrade, only to die on top of him in a hail of bullets?
Or about our own son, Ari, who spent the last Rosh Hashana of his life on
stakeout in the ditches of Nablus, a Machzor in one pocket of his
uniform, and his mother’s Yom Tov challa in the other?
Is there a single student among all of Ovadia’s disciples who could hope to
ever attain the religious merit of these heroes of the Jewish People? As
Ra’anana Chief Rabbi Yitzchak Peretz – ironically, one of Shas’ founders -
told me during our shiva: “The Talmud teaches us, in the story of the
martyrs of Lod - who saved that city from destruction - that these soldiers
who protect our nation have a higher place in Heaven than any other human
being can ever achieve.”
I fear that Rav Ovadia makes these statements because he is cut off from
the institution of the Army; he is too far removed from what is actually
occurring on the battlefield. Unlike King David or King Saul – Torah
scholars who fought in battle and sent their sons to war – he does not have
first-hand knowledge of the courage, character and caliber of our young
people in uniform. And unlike the talmidei chachamim of biblical days
– who prayed for the soldiers and studied Torah alongside them, in their
behalf, as they went into battle - the rabbis and students of these Batei
Midrash have distanced themselves from the boys in green, and have no
personal attachment to our military. And so, in that unfortunate vacuum,
these biting words can emerge from their mouths.
I believe that Rav Ovadia does, indeed, care about the soldiers. But caring
is not enough; he must show it in practice. He can start by ordering all
Shas institutions to recite the prayer for the welfare of the IDF on a
daily basis. He can urge his students to administer the synagogues at army
bases, and to supervise the kashrut there. He can ask every boy with a
Gemara in front of him to learn on behalf of a specific chayal,
invoking G-d’s blessing upon him. He himself can make it a point to visit
each and every base in order to encourage and commend the soldiers in
person.
And he can show respect and awe for our fighters. When the late Rabbi Moshe
Feinstein – no less a Talmudic master than Rav Ovadia – was visited by
former refusenik Yosef Mendelovich, the rabbi deferentially rose from his
seat. Rabbi Feinstein’s students were puzzled, for it was others who
usually stood for the rabbi, not vice-versa. Rav Moshe explained: “There
is greatness in scholarship, and there is greatness in courage. For one who
excels in heroism, even the premier Sage of the generation must rise in
respect before him.”
It would not be presumptuous to suggest that Rav Ovadia ask forgiveness
from every bereaved mother and father, for even hinting that their soldier
child was less than righteous. Teshuva, after all, is incumbent upon
even the greatest of men; this seems like a good season to put it into
practice.
Translation - Hebrew הרב עובדיה: כדאי שתלמד להכיר את הצבא שלנו.
"חכמים היזהרו בדבריכם" נאמר בפרקי אבות (א, יא). הלשון שבפינו נמשלת לנחש ארסי ולכן, כך כל פי חכמינו, יצר לה האל שני שערים – את השיניים ואת השפתיים – אשר דרכם עליה לעבור לפני שהיא יכולה לשלח את ארסה על קרבנותיה.
בהתפרצות בלתי מחושבת אחת יצר מנהיגה הרוחני של ש"ס, הרב עובדיה יוסף עוד שריפה גדולה ותקע סכין בליבותיהן של המשפחות השכולות.
"האם זה פלא אם חס ושלום נהרגים חיילים במלחמה?" שאל הרב, "הם לא שומרים שבת, לא שומרים תורה, לא מתפללים ולא מניחים תפילין בכל יום. פלא שהם נהרגים? לא פלא. ד' ירחם עליהם ויחזיר אותם בתשובה". התייסרתי רבות בניסיון להבין את אמירתו של הרב עובדיה יוסף ולמצוא בה היגיון תיאולוגי. ראשית, האם נביא הוא ויודע את מחשבות האל "מי יחיה ומי ימות?" ושנית, האם הוא טוען שחיילים שאינם שומרי מצוות נמצאים בסכנת פגיעה או חו"ח מוות גדולה יותר מאלה שכן שומרים מצוות? האם זה מבוסס על עובדות? האין הוא מבין שברגע שבחור צעיר עוטה עליו את מדי צבא הגנה לישראל ומסכן את חייו על הגנת המולדת, מייד הוא עולה לדרגה של צדיק בעיני האל? זאת ועוד: מה לדעת הרב ההסבר לנפילתם בקרב של חיילים שומרי מצוות? האם הוא בא לטעון שרמת ההקפדה שלהם לקתה בחסר ובכך נעשו חוטאים ולכן מתו? האם מסוגל הרב להבין את טוהר ליבם של הלוחמים הקדושים שהגיעו לרמה הגבוהה ביותר של מוסריות שאליה יכול בן תמותה להגיע?

I studied translation an editing in the Beit Berl college and have worked as a freelance
