non già un dovere specifico, derivante da un preesistente rapporto obbligatorio, bensì
un dovere generico. La norma fondamentale cui bisogna fare riferimento è l’art. 2043
del codice civile, in base al quale “qualunque fatto doloso o colposo che cagiona ad
altri un danno ingiusto, obbliga colui che ha commesso il fatto a risarcire il danno”.
Data la genericità dell’espressione “qualunque fatto che cagiona un danno ingiusto”,
la disposizione citata è considerata dalla dottrina una sorta di clausola generale
dell’ordinamento, realizzata attraverso la c.d. atipicità dell’illecito civile.
Translation - English A tortious act is an act by which an individual infringes a general obligation rather
than a specific obligation deriving from a pre-existing legal relationship between the
individual (tortfeasor) and another individual (plaintiff). In Italian law, article n. 2043
of the Civil Code is considered a fundamental rule when dealing with tort. Such
article states as follows:
“Any act, either malicious or culpable, causing an unjust damage to an individual,
binds the individual who committed such act to pay the other individual
compensation.”
In view of the indeterminateness of the expression " Any act causing an unjust
damage", the article is considered by the authorities as a sort of general legal
principle, realized through the so-called “atypicalness” of tortious acts.

Source text - English THIS TRUST AGREEMENT (the "Agreement") is made as of the .... Day of ...., 2005, by CORPORATION FOR NATIONAL RESEARCH INITIATIVES, a District of Columbia non-profit corporation ("CNRI"), INTERNET SOCIETY, a District of Columbia non-profit corporation ("ISOC"), as Settlors, the INTERNET ENGINEERING TASK FORCE ("IETF"), and the INITIAL TRUSTEES defined herein.
ARTICLE I - IDENTIFICATION OF TRUST
Name. The trust created by this Agreement shall be known as the "IETF Trust."
• ARTICLE II - PURPOSE OF TRUST
2.1 Purpose. The purposes for which the Trust is organized and operated are to engage exclusively in such charitable, educational, and scientific activities as may qualify it for exemption from federal income tax under Section 501 (c) (3) of the Code (as defined below). Such purposes include, but are not limited to, the advancement of education and public interest by acquiring, holding, maintaining and licensing certain existing and future intellectual property and other property used in connection with the internet standard process and its administration, for the advancement of the science and technology associated with the Internet and related technology.
• ARTICLE IV - BENEFICIARY
The Beneficiary of the Trust shall be the IETF as a whole and not any individuals who may participate in IETF activities or either of the Settlors. In the event that the IETF ceases to, or plans to cease to, develop technical standards for the Internet, then upon and only upon the express written consent of the IESG, or the IESG's successor as the leadership of the IETF, the IETF's successor with respect ti the development of technical standards for the Internet shall become the successor Beneficiary under this Trust; provided that neither of the Settlors nor any affiliate of either Settlor shall become such successor organization or successor Beneficiary, and provided, further, that if either the IESG or its successor does not consent to the IETF's successor becoming the beneficiary hereunder, or if neither the IESG nor its successor are then existing, the successor Beneficiary shall be jointly designated by the Settlors.
• ARTICLE VI - TRUSTEES
6.1 Trustees; Successor Trustees.
The Trustees shall consist of Eligible Persons who have agreed in writing to become, and to fulfill the duties of, Trustees hereunder. No Person who is not an Eligible Person shal be permitted to become a Trustee hereunder. Individuals shall be eligible to be Trustees only for so long as they are Eligible Persons. In the event from time to time individuals who are not currently Eligible Persons become Eligible Persons, such individuals shall become Trustees hereunder upon agreeing in writing to become, and to fulfil the duties of, Trustees hereunder. By executing this Agreement, the individuals listed on the signature page hereto under the heading "Initial Trustees" are agreeing to become, and to fulfill the duties of, Trustees hereunder, and no further writing or instrument shall be necessary in order for such individuals to become Initial Trustees hereunder.

Gli scopi del Trust includono, ma non si limitano a, la promozione dell’istruzione e dell'interesse pubblico attraverso l'acquisizione, il possesso, la manutenzione e la concessione in licenza di determinate proprietà intellettuali esistenti o future e altre proprietà utilizzate in relazione ai processi standard di Internet e alla loro amministrazione, per il progresso scientifico e tecnologico relativo ad Internet e alle tecnologie correlate.
ARTICOLO IV – BENEFICIARIO
Il Beneficiario del Trust sarà la IETF come entità giuridica, non individui che possono prendere parte alle attività della IETF, né i Disponenti. Nel caso in cui la IETF cessi, o abbia intenzione di cessare, di sviluppare standard tecnici per Internet, allora solo e soltanto con un consenso scritto della IESG, o del successore della IESG alla guida della IETF, il successore della IETF diventerà il successore Beneficiario di questo Trust nello sviluppo di standard tecnici per Internet. Il successore Beneficiario dovrà essere scelto congiuntamente dai Disponenti: a) dato che nessuno dei Disponenti, né un socio di uno dei Disponenti può diventare l’organizzazione-successore o il successore Beneficiario; b) se la IESG o il suo successore non danno il consenso al successore della IETF di diventare il Beneficiario di questo Trust; c) se sia la IESG sia i suoi successori hanno cessato di esistere.
• ARTICOLO VI - I TRUSTEES.
6.1 i Trustees; i Trustees successori.
I Trustees dovranno essere scelti tra le persone aventi diritto, che in virtù di questo atto hanno concordato in forma scritta di diventare, e di adempiere ai compiti di, Trustee. Nessun soggetto che non sia una persona avente diritto potrà essere autorizzato a diventare un Trustee in virtù del presente atto. Gli individui potranno avere diritto a diventare Trustee solo ed esclusivamente nel caso in cui siano persone aventi diritto. Nel caso che, di quando in quando, individui che non siano al momento persone aventi diritto lo diventino, tali individui potranno diventare Trustees in virtù di questo atto previo accordo scritto per diventare, e adempiere ai compiti del Trustee. Nel rendere esecutivo questo Accordo, gli individui indicati nella pagina delle firme qui di seguito sotto l'indicazione "Trustee Iniziali" accettano di diventare, e di adempiere ai compiti di, Trustee in virtù di questo atto, e nessun altro documento scritto o strumento sarà necessario a tali individui per diventare Trustee Iniziali in virtù di questo atto.

Source text - Italian L'assicurazione marittima può riguardare i beni destinati all'esercizio della navigazione o le
responsabilità nel caso di infausti eventi.
La prima copre i danni che possono colpire la nave o il carico in senso lato causandone la perdita o
il danneggiamento laddove la loro entità è solo indirettamente rilevante giacché ad essi è riferito
l'obbligo del risarcimento, trasferito dall'assicurato all'assicuratore.
L'assicurazione contro le responsabilità, invece, serve a mallevare l'assicurato dagli obblighi
risarcitori nei confronti dei terzi danneggiati, con copertura dell'intero suo patrimonio.
In linea di principio, la copertura assicurativa può riferirsi a fatti leciti quali le spese di assistenza o
di salvataggio ovvero la contribuzione nelle avarie comuni, ma può riguardare anche fatti illeciti
purché non dolosi quali l'arenamento, l'incaglio, la collisione con navi di terzi ed i danni derivati a
terzi, in genere, in dipendenza dell'attività di navigazione. Tali ipotesi possono riferirsi solo ad
eventi illeciti colposi.
Quanto alle pertinenze assicurabili, esse sono definite dall'art. 246 del cod.nav. il quale cita le
imbarcazioni (di salvataggio e di servizio), gli attrezzi e gli strumenti, gli arredi ed in genere tutte le
cose destinate in modo durevole a servizio o ad ornamento della nave.
Ai sensi dell'art. 516 del Codice della Navigazione l'assicurazione delle merci copre il loro valore
allo stato integro al luogo di destinazione ed al momento della discarica. Nel caso in cui tale valore
non fosse accertabile, il valore assicurabile è computato analiticamente al prezzo corrente delle
merci nel luogo e al tempo della caricazione aumentato del dieci per cento a titolo di profitto
sperato nonché delle spese sostenute fino al loro stivaggio, del nolo dovuto o eventualmente
anticipato del premio e delle spese di assicurazione.
Translation - English Marine insurance is a form of insurance which may indemnify the insured against physical loss or
damage to ship’s hull and machinery (hull insurance), or any liability to a third party occurring
during a sea voyage (liability insurance).
Marine hull insurance covers physical loss or damage to hull and machinery. Since the insured
transfers to the maritime underwriter the obligation to cover only damages related to hull and
machinery, the insurance might cover against subconsequent cargo loss or damage, only where the
entity of the aforesaid damage is indirectly relevant.
In liability insurance, on the other hand, the insurer undertakes to indemnify against the loss which
the insured may suffer on account of liability to a third party. The insured’s assets are fully insured.
In principle, insurance coverage may refer to legitimate acts such as expenses associated with
assistance or rescue operations, as well as contributions to general average. It may also refer to
illegitimate acts (provided that they are not malicious) such as stranding, collision with third-party
vessels and subsequent damages to third parties and all those other acts generally related to sailing.
Article 246 of the Italian Code of Maritime navigation sets all the vessel accessories which can be
insured, such as the vessel’s ancillary crafts (including lifeboats, pilot boats and tug-boats,), tools
and equipment, furnishings and, in general, all the spare parts appointed for a long-lasting use on
boat, or for its ornament.
Under Article 516 of the Italian Code of maritime navigation, cargo insurance compensates for the
loss or damage in terms of the value of the insured goods when delivered in good condition at the
port of discharge and place of delivery. In the event that the aforesaid value were not ascertainable,
the insurable value is calculated on the basis of the goods current price at place and time of loading,
increased of a tenth of its value. This is by way of compensation for prospective profits, as well as
for stowage charges, freight or as eventual insurance premium in advance, and insurance expenses.
