Source text - Spanish En este sentido resultan relevantes las reflexiones del sociólogo alemán Niklas Luhmann, que considera la identidad como una entidad maleable y en constante evolución. Luhmann analiza el concepto de identidad como construcción en relación a la individuación. Sostiene que la identidad se articula como proceso siempre activo en el que el yo crece y se va formando a lo largo de toda la vida en función de la experiencia. Asimismo, la construcción de identidad se realiza siempre mediante dos caminos: a través de la diferencia con lo otro y a través del vínculo con lo otro.
En Freire, la desvinculación con la realidad y la consecuente alienación de sus protagonistas devienen acicates que provocan una huida, una búsqueda de identidad más acorde con sus anhelos y su sentir en el mundo. La dinámica se repite: tras los intentos frustrados de crear vínculos con la sociedad, se hace patente la incapacidad para adaptarse al sistema social vigente. Aparece la lucha interior por la discrepancia entre el modelo ensalzado como ideal y el verdadero yo. En esa misma línea se sitúan los personajes de Martín Gaite, como ella misma reconoce: 'la "fugata nata" es la protagonista típica de mi narrativa'.
La reconstrucción del yo comienza su andadura como consecuencia de la rebeldía de los personajes, que a menudo les condena a la marginación. Estas protagonistas, 'chicas raras' , constituyen todo un modelo literario cuyo origen se remonta a la protagonista de Nada de Carmen Laforet. Andrea se despliega como un personaje femenino en lucha con su entorno dentro de una novela que se puede tildar de existencial. Nada presenta una alternativa a la novela rosa 'habitualmente leída y cultivada por mujeres' (Desde la ventana, 101) y establece un nuevo modelo literario.
Translation - English In this regard the reflections by German sociologist Niklas Luhmann are here relevant given his understanding of identity to be a malleable entity in a constant state of evolution. Luhmann analyses the concept of identity as construction in relation to the notion of individuation. He argues that identity is articulated as a permanently active process whereby the self grows and is formed throughout life depending on different experiences. Similarly, the construction of identity always takes place via two different paths - through the difference with the other and through the bond with the other. 6
In Freire, the disassociation with reality and the consequent alienation of her protagonists become incentives that provoke a flight, a search for identity more consistent with her aspirations and her feelings in the world. This dynamic repeats itself - after various frustrated attempts to establish different bonds with society, the inability to adapt to the existing social system becomes apparent. The inner struggle caused by the discrepancy between the model praised as the ideal and the real ‘self’ arises. Martín Gaite’s characters fit a similar mould as she herself has acknowledged: 'the “innate escape artist” is the archetypal protagonist of my narrative'.7
The reconstruction of the ‘self’ begins as a result of the rebellion of the characters and this often relegates them to a state of marginalisation. These type of protagonists, the so-called 'strange girls' 8 constitute a literary model per se the origin of which can be found in Carmen Laforet’s main character in Nada. Andrea is portrayed in this novel which, could accurately be labelled as existentialist, as a female at odds with her surroundings.

Source text - Spanish La mediación constituye fórmula de autocomposición de los conflictos e instrumento eficaz para la resolución cuando la controversia afecta a derechos subjetivos de carácter disponible. Son numerosas las ventajas que se le atribuyen, por citar algunas, su capacidad para dar soluciones prácticas, efectivas y rentables a determinados conflictos entre partes.
En España, el Real Decreto-ley incorpora al Derecho español la Directiva 2008/52/CE del Parlamento Europeo y del Consejo, de 21 de mayo de 2008, sobre ciertos aspectos de la mediación en asuntos civiles y mercantiles. La citada Directiva 2008/52/CE establece unas normas mínimas para fomentar la mediación en los litigios transfronterizos en asuntos civiles y mercantiles.
La regulación del Real Decreto Ley pretende, sin embargo, ir algo más allá del contenido que la Directiva 2008/52/CE exigía transponer a nuestro ordenamiento jurídico y conforma todo un régimen general aplicable a la mediación civil y mercantil con la convicción de constituye uno de los mecanismos de garantía de una justicia de calidad y de la tutela judicial de los derechos de los ciudadanos. En este sentido, se afirma que la mediación es una institución ordenada a la paz jurídica, que contribuye concebir a los tribunales de justicia como un último remedio y hábil coadyuvante para la reducción de la carga de trabajo de aquéllos, dado que reduce su intervención a aquellos casos en que las partes no logren poner fin a la contienda desde el acuerdo. Es por ello que la norma recientemente promulgada reconoce a la mediación su carácter de instrumento complementario de la Administración de Justicia y alternativa al proceso judicial o a la vía arbitral.
Sigue para ello las previsiones de la Ley Modelo de la CNUDMI sobre Conciliación Comercial Internacional del año 2002 y es dictada bajo la forma de real decreto ley y con cierta premura dado que el plazo de incorporación al ordenamiento jurídico español de la Directiva 2008/52/CE finalizó el 21 de mayo de 2011. Se justifica así el recurso al Real Decreto-ley, como norma que efectúa esa necesaria y urgente adaptación de nuestro Derecho.
Translation - English Mediation is an effective tool for the resolution of conflicts involving subjective, unrestricted rights. Many advantages have been attributed to the process of mediation, including the ability to provide practical, effective and profitable solutions to a broad range of disputes between parties1.
In Spain, the Royal Decree-Law on mediation (RDL 5/2012, 5th may)2 incorporated into the Spanish law the European Parliament and Council Directive 2008/52/EC, of 21 May 2008, on certain aspects of mediation in civil and commercial matters3. The mentioned Directive was set up to establish a range of minimum standards to encourage the use of mediation in cross-border disputes in relation to civil and commercial matters.
The Royal Decree aims to reach beyond the content that was expected to be applied to our legal system by Directive 2008/52/EC. In fact, it has developed a comprehensive scheme of mechanisms for civil and commercial mediation that ensures the quality of justice and the judicial protection of the rights of citizens. In this sense, it is argued that mediation is an institution designed to achieve legal peace, resorting to the use of courts as a last option. This, consequently, contributes to the reduction of the workload of the courts as it limits its participation in the process to only those cases when the parties involved in a conflict are unable to find a resolution by means of an agreement. This is why the recently enacted rule recognises mediation to be a complementary tool to the Administration of Justice and an alternative to court proceedings or arbitration.
Based on the provisions of the 2002 UNCITRAL Model Law on International Commercial Conciliation, it has been formatted as a royal decree with some urgency given that the deadline for transposition of Directive 2008/52/EC into Spanish law ended on 21 May, 2011. Thus having selected a Royal Decree-Law as the appropriate format has been the result of the necessary and urgent adaptation to our legal system.
