: Action to raczej powództwo, a „act in the capacity” to nie to samo, co „być”. „Another” oznacza „inną” stronę, a nie „drugą”. „Proxy” to nie każdy pełnomocnik, raczej odnosi się do głosowania, zawierania małżeństwa, prokury i innych szczególnych przyp.

Dziękuję za wyjaśnienia. W ostatecznym wpisie zmieniłam na 'the other', "legal action" za słownikiem Jerzego Pieńkosa "czynność prawna, a 'in the capacity" jako "w charakterze" nie jest wpisane w ostatniej wersji. Po Twojej uwadze zmieniłam na "attorney".

Thanks again. This time it's at least supported by a translation of the Civil Code. The key issue is "the other party". I'm pretty sure I'm right.

Pełnomocnik nie może być drugą stroną czynności prawnej, której dokonywa w imieniu mocodawcy, chyba że co innego wynika z treści pełnomocnictwa albo że ze względu na treść czynności prawnej wyłączona jest możliwość naruszenia interesów mocodawcy. Przepis ten stosuje się odpowiednio w wypadku, gdy pełnomocnik re-prezentuje obie strony."
Tylko zastanawiam się, czy "the other", nad którym też się zastanawiałam, nie ogranicza stron czynności do dwóch, a przecież może być czynność w ogóle jednostronna, której dokonuję ja i mój pełnomocnik, stąd propozycja "another".
"Ponadto, w praktyce może dojść do sytuacji, w której ustanowiony przez nas pełnomocnik będzie drugą obok nas, stroną czynności prawnej. W takiej sytuacji istotnym jest, że pełnomocnik może być drugą stroną czynności prawnej, której ma dokonać na rzecz mocodawcy, jeśli wynika to z treści pełnomocnictwa. Takie działanie pełnomocnika, jako drugiej strony czynności prawnej jest również dopuszczalne, jeśli w wyniku dokonania w ten sposób czynności nie dojdzie do naruszenia interesów mocodawcy (kwestia ta w praktyce może jednak budzić wątpliwości, jeśli zatem pełnomocnik sam ma być drugą stroną czynności – np. umowy – warto wyraźnie zastrzec taką możliwość w treści pełnomocnictwa). Analogiczne zasady mają zastosowanie do sytuacji, w której pełnomocnik reprezentuje dwie strony czynności prawnej (np. jednocześnie sprzedawcę i kupującego, przy umowie sprzedaży)."
Ale oczywiście mogę się mylić.
